Terms of Service

1. Acceptance of Terms

By accessing or using Askertain (“the Service”), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Description of Service

Askertain provides a platform that enables businesses to embed question interceptors on their websites to collect real-time attribution and conversion feedback from their visitors. The Service includes a dashboard, embed script, analytics, and integrations.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

You must provide accurate information when creating your account and keep it up to date.

4. Acceptable Use

You agree not to use the Service to:

• Collect personal data from your visitors without appropriate disclosure and consent.
• Engage in deceptive, misleading, or fraudulent practices.
• Violate any applicable law or regulation.
• Interfere with or disrupt the Service or its infrastructure.
• Attempt to gain unauthorized access to any part of the Service.
• Use the Service to harass, harm, or discriminate against any person.

5. Subscription & Payment

The Service is offered on a subscription basis. Fees are billed in advance on a monthly basis. All fees are non-refundable except as required by law or expressly stated otherwise.

We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Data Ownership

You retain ownership of all data collected through your interceptors. By using the Service, you grant Askertain a limited license to store, process, and display that data solely for the purpose of providing the Service to you.

7. Intellectual Property

The Askertain platform, including its software, design, and documentation, is owned by Askertain and protected by intellectual property laws. Nothing in these Terms grants you ownership of any Askertain intellectual property.

8. Termination

You may cancel your account at any time. Upon cancellation, your access to the Service will continue until the end of the current billing period.

We reserve the right to suspend or terminate your account for violation of these Terms, with or without notice depending on the severity of the violation.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASKERTAIN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which Askertain is incorporated, without regard to its conflict of law provisions.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice in the dashboard. Continued use of the Service after changes take effect constitutes acceptance.
